Anime News Network is reporting that Christopher Handley, the Iowa man charged with “obscenity” for graphic depictions of “children being sexually abused” contained in his manga collection, has had his sentencing delayed until February 8. Handley pled guilty to charges stemming from the possession and importation of obscene material that contained “visual representations of the sexual abuse of children, specifically Japanese manga drawings of minor females being sexually abused by adult males and animals” and now faces up to 15 years in prison and a $250,000 fine.
Handley entered his plea under “Title 18, United States Code, Section 1466A(b)(1), which prohibits the possession of any type of visual depiction, including a drawing, cartoon, sculpture, or painting, that depicts a minor engaging in sexually explicit conduct that is obscene.” As a result he was forced to forfeit all seized property which included two computers and seven volumes of manga.
Both prosecution and defense agreed to the delay in sentencing in light of the fact that the United States Probation Office was late filing the Final Presentence Investigation Report. The two sides are also “discussing the potential of a joint sentencing recommendation, and need time for additional discussions.” According to the motion, Handley is not currently in custody while awaiting his sentencing.
